Biovella LLC, doing business as Biovella Beauty (“Biovella Beauty,” “we,” “us,” or “our”)

IMPORTANT: Read this entire agreement before accepting. Access to private shopping areas is restricted to approved account holders. Acceptance does not waive rights that cannot lawfully be waived.

1. Eligibility and Age

I certify that I am at least 21 years old, that the registration information I provide is accurate, and that I am registering for myself. Biovella Beauty may verify eligibility and may deny or restrict private access for legitimate, lawful business reasons. Approval is not guaranteed.

2. Research Use Only; Prohibited Applications

PRODUCTS EXPRESSLY LABELED “RESEARCH USE ONLY” (RUO) ARE NOT INTENDED FOR HUMAN OR ANIMAL USE, INCLUDING INGESTION, INJECTION, ADMINISTRATION, IMPLANTATION, OR OTHER HUMAN OR VETERINARY APPLICATION. THEY ARE NOT OFFERED FOR DIAGNOSIS, TREATMENT, CURE, OR PREVENTION OF DISEASE.

This applies to any RUO-labeled research peptides, botulinum toxin preparations, or other research materials offered on the site. RUO labeling does not establish regulatory approval, lawful sale, or fitness for a particular use. Products not labeled RUO remain subject to their own intended uses, labeling, manufacturer instructions, and applicable law. I agree to follow all applicable restrictions and not use RUO merchandise for prohibited purposes.

3. Purchaser Responsibility and Risks

I am responsible for reviewing descriptions, labels, warnings, applicable laws, storage instructions, and intended-use limitations before purchase. Unauthorized or improper handling or use may cause allergic or adverse reactions, contamination, infection, tissue damage, permanent disability, life-threatening complications, or death. I understand that Biovella Beauty does not authorize or instruct human or animal application of RUO products. I am responsible for my independent purchasing decisions and lawful handling and use.

4. Liability Limitations

TO THE FULLEST EXTENT PERMITTED BY LAW, BIOVELLA BEAUTY AND BIOVELLA LLC, INCLUDING THEIR OWNERS, MEMBERS, EMPLOYEES, AND AGENTS, DISCLAIM LIABILITY FOR LOSSES OR INJURIES ARISING SOLELY FROM A PURCHASER’S UNAUTHORIZED, IMPROPER, OR PROHIBITED USE OF MERCHANDISE, INCLUDING SERIOUS INJURY OR DEATH, TO THE EXTENT SUCH LIABILITY MAY LAWFULLY BE EXCLUDED.

No provision releases Biovella Beauty from liability for defective products, negligence, misrepresentation, statutory obligations, or any other liability to the extent it cannot legally be excluded or limited. No disclaimer guarantees that a claim will be barred. Any enforceable limitation is subject to applicable law.

5. No Medical or Individualized Professional Advice

Biovella Beauty is a retailer, not a medical provider. We do not provide individualized medical advice, diagnosis, treatment recommendations, dosing, dilution, reconstitution, injection or administration instructions, or treatment protocols. Website content, customer messages, social posts, and community communications are general information only and do not create a clinician–patient relationship. Customer support can assist with account access, orders, published product information, shipping, and other administrative matters. Seek qualified professional guidance where appropriate; do not rely on Biovella Beauty for medical decisions.

6. Storage and Handling

I will review applicable product and manufacturer storage/handling information. After successful delivery, I am responsible for appropriate storage and handling. Biovella Beauty is not responsible for deterioration, damage, contamination, or alteration caused by improper storage or handling after delivery, except as required by law.

7. Temperature-Sensitive Shipments

CONTINUOUS REFRIGERATION, FREEZING, OR TEMPERATURE-CONTROLLED TRANSIT IS NOT GUARANTEED UNLESS EXPRESSLY AGREED IN WRITING FOR THE SPECIFIC ORDER.

Some shipments may include ice packs or cooling materials as a supplemental precaution only; they are not a refrigeration service and may arrive warm or thawed. Carrier environments and transit times can vary. Standard or expedited shipping does not itself guarantee a temperature range, stability, integrity, safety, or suitability. Report concerns promptly; this provision does not eliminate remedies for defective, misrepresented, or nonconforming goods required by law.

8. Order Review and Accuracy

Before payment, I will verify product selections, quantities, variants, address, contact information, shipping method, promotional codes, and total. Submission authorizes payment processing and fulfillment. Requests to correct mistakes must be made promptly and are not guaranteed.

9. Cancellation, Modification and Fees

Customer-requested cancellation or modification is available only if Biovella Beauty approves it before shipment. Once an order ships, it cannot be canceled or modified through Biovella Beauty. For an approved customer-requested cancellation, a $10.00 cancellation/restocking charge plus payment-processing fees actually incurred and not returned to Biovella Beauty may be deducted from the refund, but only to the extent lawful and disclosed before purchase. Any remaining eligible refund is issued to the original payment method. A requested change that requires cancellation/replacement may incur disclosed charges. These deductions do not apply to Biovella Beauty’s own inventory or fulfillment errors, inability to fulfill, or situations where law requires a full refund. We will not charge more than applicable law permits.

10. Discount Codes and Retroactive Requests

Discount codes must be correctly applied before checkout. We do not issue retroactive refunds solely because a customer forgot a code. At our discretion, we may offer an eligible equivalent promotional accommodation as store credit toward a future order, subject to applicable law and disclosed credit terms. Invalid, expired, unauthorized, or ineligible codes will not be honored.

11. Final Sales, Returns and Exchanges

ALL SALES ARE FINAL EXCEPT FOR QUALIFYING DAMAGE, INCORRECT OR MISSING MERCHANDISE, NONCONFORMING GOODS, OTHER EXPRESSLY STATED EXCEPTIONS, OR RIGHTS REQUIRED BY LAW.

No returns, refunds, or exchanges are offered solely for change of mind, incorrect selection, buyer’s remorse, personal preference, or products opened, used, altered, or improperly stored after delivery. Customers should promptly report merchandise that arrives broken, damaged, incorrect, or incomplete. We may request photographs of the product, outer packaging, shipping materials, and order details where reasonably necessary. Do not return merchandise without authorization. We will review verified issues and provide an appropriate remedy consistent with applicable law; refunds, replacement, or store credit may be available depending on the circumstances.

12. Shipping and Delivery

Published delivery windows are estimates unless a specific guarantee is expressly stated. We strive to process orders according to our posted schedule, but carrier routing, weather, backlogs, and other events may cause delays. I am responsible for an accurate, deliverable address and safe receipt. We will reasonably assist with available tracking information and carrier inquiries, without waiving rights applicable to lost or undelivered goods.

13. Order Concerns and Investigation

Biovella Beauty aims to resolve legitimate problems fairly, including damage, missing products, and fulfillment mistakes. Customers are encouraged to contact Support promptly and give us a reasonable opportunity to investigate. We maintain inventory and fulfillment records that may help determine whether an item was omitted; those records are not conclusive in every case. Customers agree to provide accurate information and reasonable supporting evidence. Where a refund or other remedy is due, we will work to provide it in accordance with applicable law.

14. Chargebacks, Disputes and Future Purchasing Access

Customers are strongly encouraged to contact Biovella Beauty Support first, whenever reasonably possible, so we can investigate and attempt to resolve concerns before a chargeback or payment reversal. We will make reasonable efforts to correct verified problems, including damaged, incorrect, or missing merchandise.

Where legally permissible, Biovella Beauty may permanently terminate private-access and future purchasing privileges when a customer initiates a chargeback without first giving us a reasonable opportunity to resolve an issue, particularly where the circumstances indicate misuse or abuse of the dispute process. Restrictions apply to the customer relationship, including attempted circumvention through alternate accounts, and may include refusal of future orders. Any decision is subject to lawful, nondiscriminatory application and the specific circumstances. A chargeback alone does not establish fraud or wrongdoing.

Nothing requires a customer to contact us first where law or payment-network rules permit a direct dispute, restricts any nonwaivable dispute or consumer right, or imposes a financial penalty for exercising such rights. We reserve the right to refuse future service for legitimate, lawful reasons.

15. Competitor Affiliations and Restricted Access

Private shopping access is intended for approved purchasers. To protect confidential business information, commercial relationships, and operations, Biovella Beauty may deny or revoke access for individuals actively acting on behalf of competing businesses, including owners, officers, employees, contractors, consultants, affiliates, ambassadors, or promotional representatives, where there is a legitimate conflict of interest or commercial-access concern.

I will not misrepresent my identity, affiliations, or purpose in seeking access. Credible concerns may be reviewed. Where legally permissible, ineligible accounts may be restricted or permanently terminated, and unfulfilled orders canceled with refunds handled as required by law. Circumventing restrictions using alternate identities or third parties is prohibited. Merely following or buying from another business does not automatically make an ordinary customer ineligible. This policy will be administered lawfully and without prohibited discrimination.

16. Account Security and Private Access

I will protect my account credentials and will not share restricted access information with unauthorized persons or use another person’s account to evade restrictions. Suspicious activity may prompt verification or temporary restriction. Private access is discretionary and may be revoked for legitimate policy violations or lawful business reasons.

17. Right to Refuse Future Business

Biovella Beauty may decline future transactions or discontinue customer relationships for lawful reasons, including documented payment abuse, fraud, threats, harassment, misuse of private access, material policy violations, or legitimate conflicts of interest. This right does not permit unlawful discrimination or override existing contractual, refund, or statutory obligations.

18. Other Policies, Changes and Governing Law

Orders are also subject to the Terms of Service, Shipping Policy, Refund Policy, Privacy Policy, and product-specific notices available before purchase. Material changes to this agreement may require renewed acceptance. This agreement is governed by North Carolina law except where mandatory law or conflict-of-law rules require otherwise. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law.

19. Electronic Consent and Acknowledgment

By typing my full legal name, confirming the system-generated acceptance date, checking the acknowledgment box, and selecting “I Agree & Continue,” I acknowledge that I am at least 21, have had the opportunity to review the entire agreement, understand RUO restrictions and risks, understand the absence of medical advice, accept the stated lawful limitations and order policies, and intend my electronic action to constitute a legally binding signature. I consent to the use and retention of electronic acceptance records in accordance with the Privacy Policy and applicable law.
